The Powerade School Challenge 2010
* Open to students between the 11 and 15 years of age.
* Open to Maltese Citizens only.
* Registrations will be accepted until 25th April 2010.
* All registrations must be submitted by a legal guardian.
* The event will take place between April 2010 and June 2010.
The organisers reserve the right to take action against any teams who submit offensive participant names, attempt to have duplicate participations in multiple teams or attempt to tamper with the quiz system in any other way, by immediate disqualification without prior warning or notification.
Terms & Conditions applicable to Participants in the ‘POWERADE SCHOOL CHALLENGE 2010
A. Overview of the Powerade School Challenge 2010
1. The Powerade School Challenge 2010 (the Competition) is a competition organised by The General Soft Drinks Co Ltd (the “Organisers”) through which teams of four students aged 11 to 14 , with the permission of a legal guardian, can participate in a quiz challenge. Registrations are to be submitted through www.powerade.com.mt (The Website)
B. Eligibility
1. Children under the age of 11 or over the age of 15 are not eligible to participate in the Competition. The Competition is open to Maltese Residents only.
2. The organisers reserve the right to take action against any teams who submit offensive team or participant names, attempt to have duplicate participations in multiple teams or attempt to tamper with the quiz system in any other way, by immediate disqualification without prior warning or notification..
C. Duration of Competition
1. The Competition, in the form of an Online Quiz, will commence on the 10th May 2010. The final rounds of the Competition will be in the form of a Televised Quiz, which will be broadcast on a local TV Station,
D. Registration and Participation
1. All registrations must be submitted between the 12th April and the 25th April 2010. ANY REGISTRANTS USING OFFENSIVE OR OTHERWISE UNACCEPTABLE TEAM OR PARTICIPANT NAMES WILL BE AUTOMATICALLY DISQUALIFIED FROM THE COMPETITION.
2. Eligible Individuals may enrol in the Competition through The Website. To enrol, a parent or legal guardian of one of the participants must click on the ‘Register Your Team Today!’ button and follow the onscreen instructions to create an Account. Any information submitted – including but not limited to Name, Mobile Number, ID Number and E-Mail Address - must be correct and accurate in order to validate participation
3. Once registered, the team is expected to download and study the material provided in the “STUDY MATERIAL” section The Website.
4. Once the study material has been downloaded and studied, as from the 10th May 2010, participants are expected to take the online quiz by answering multiple-choice questions about topics including: Sports Education, Nutrition and Active Lifestyle.
5. The quiz is divided into two phases i.e the online phase and the Final TV Quiz phase.
6. The Online Quiz session will consist a number of multiple-choice questions, which will be randomly selected from a pool of questions.
7. To qualify for the Final TV Phase, the total point value of the team must be within the top 8 teams.
8. Teams failing to qualify for the Final TV Quiz will be eliminated.
9. The winning team will win the first prize of 1,000 Euros worth of books and sports material. The teams ranking second to eight will receive consolation prizes.
10. Prizes are non-transferable and CANNOT be exchanged for cash or other prizes
E. Modifications and Termination of the Competition
1. The Organisers reserve the right to modify any of the Terms and Conditions set forth herein – including but not limited to, the duration of the Competition & the eligibility of any contestant to participate or claim prizes.
2. The Organiser reserves the right to terminate or temporarily suspend the Competition at any time, for any reason, with or without notice, even though the termination may affect any Participant’s ability take part in the Competition.
3. Participation in the Competition constitutes the Enrolee’s acceptance of any changes to these Terms and Conditions. Enrolees are responsible for remaining knowledgeable as to any changes that the Organiser may have made to these Terms and Conditions. The most current version of the Terms and Conditions will be made available on The Website (www.powerade.com.mt) and will supersede all previous versions of these Terms and Conditions.
F. General Terms and Conditions
1. By registering to access the competition, Participants are offering consent for the Organisers to process any personal data in accordance with Maltese Data Protection laws. Registrants agree to keep any personal login name and password for use on the Site Website confidential, and to be responsible for any loss or damage resulting from use of your password by any third party.
2. The Organisers reserve the right to discontinue the participation privileges of any Enrolee who engages in any fraudulent activity or uses the Competition in a manner inconsistent with these Terms and Conditions or any national law statutes or ordinances. Discontinued participation privileges may result in the annulment of previous victories. In addition to discontinuance of participation privileges, the Organisers shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.
3. The Organisers are not responsible for any incorrect or inaccurate information supplied by Enrolees while participating in the Competition.
4. All questions or disputes regarding eligibility of
the Competition, or an Enrolee’s compliance with these Terms and
Conditions will be resolved by The Organisers in its sole discretion.
G. Limitation of Liability
1. The Organisers are not responsible for incorrect or
inaccurate transcription of information related to any of the equipment
or programming associated with the Competition or utilized by the
Enrolee, for any human error, for any interruption, deletion, omission,
defect, or line failure of any telephone network or electronic
transmission, for problems relating to computer equipment, software,
inability to access The Website or online service or for any other
technical or non-technical error or malfunction.

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL
ANY OF THE RELEASES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE COMPETITION OR
MERCHANDISE & REWARDS OFFERED THROUGH THE PROGRAM, EVEN IF ANY OR
ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF THE ORGANISER
IMPROPERLY DENIES AN ENROLEE ANY POINTS, LIABILITY WILL BE LIMITED TO
THE EQUIVALENT AMOUNT OF POINTS.
3. The Organisers, its joint ventures, officers, directors, employees, shareholders, promotion agencies, agents, successors, assignee, and service providers, are not responsible for any products or services offered by the Prizes suppliers.
4. TO THE FULLEST EXTENT ALLOWABLE BY LAW, THE ORGANISERS AND THE PROMOTIONAL SUPPLIERS SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND/OR SERVICES OFFERED BY ANY PRIZES PARTNER, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
5. As a condition of participating in this Competition, Enrolees agree that any and all disputes, claims, and causes of action arising out of or connected with this Program, of any Prizes obtained through the Program, shall be resolved individually, without resort to any from of class action and non-exclusively by the Courts of Malta;
6. All issues and questions concerning the construction, validity, interpretation and enforceability of the Terms and Conditions, or the rights and obligations of Enrolee and The Organisers in connection with Program, shall be governed by, and construed in accordance with, the laws of Malta without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Malta.
7. These Terms and Conditions constitute the entire
agreement between Program participants and the Organiser pertaining to
the subject matter herein and supersedes all prior or other
arrangements, understandings, negotiations and discussions, whether
oral or written. No waiver of any of the provisions of these Terms and
Conditions shall be deemed or shall constitute a waiver of any other
provisions hereof (whether or not similar), nor shall waiver constitute
a continuing waiver unless otherwise expressly provided.
8. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
